California State Militia to fight marijuana raids by the Feds? Is this extreme?
I’m still confused how state laws can contradict federal laws. What right if any does the state have to protect it’s own citizens from meddling federal agents. This doesn’t even have to be about marijuana, it could be any law where we have this state vs fed conflict. I’m not advocating violence but what alternative is there to stop paramilitary forces like the DEA, ATF, etc from violating your state rights?

The Civil War pretty much put the Federal/State ultimate sovereignty issue to rest
States have tried to fight federal rules before and the feds always win. The 10th Amendment to the constitution is apparently meaningless.
DEA ATF don’t violate your state rights. They enforce federal law.

The anti-federalist lost this case along time ago; With the wide interpretation of the commerce clause combined with mandatory language in order for states to receive federal monies, the federal government has become the absolute authority
In your example POT, the federal government through the commerce clause justify its enforcement of the drug laws within CA even though CA state under the 10th amendment police power has the authority ;but the fed’s make the argument of organized crime etc but this same federal government makes no such connection with prostitution and allows the state to legalize prostitution or criminalize it two states RI and NV allow prostitution in some manner, but could not the same argument be made with prostitution? Organized crime likely involved, money laundering etc across state lines
State should have power over it’s people. Our reps actually live here. They know what’s going on, and we elected them.
There wasn’t even a federal law until 1940, I believe. We do need to fight. Most people are afraid of the cops and the feds. I say they should be afraid of us. We outnumber them and still have the second amendment. People’s lives are being ruined. Obama said they will not interfere with anyone following the compassionate use laws. How many times did the dea interfere with state law under W?
First, as to the California Medical Marijuana law, the U.S. Supreme Court has ruled that federal law supersedes state laws on this issue under the Commerce Clause of the U.S. Constitution. So the raids are legal, and if the State Militia tried to stop them, they can be in serious legal trouble also. This doesn’t mean I agree with the Supreme Court ruling, but the only way to overturn that is for them to reverse their decision or an amendment to the Constitution.
Now for the bad news: There is no fight. The feds are not doing raids anymore under Obama. He has told his Justice Department that he does not want to overrule state laws on this. So the California State Militia is just going to make a bigger fool out of themselves than they already have.
If California legalized marijuana for recreational use the worse that will happen is the feds will threaten to cut off the state’s federal highway funds.
Marijuana used to be legal in Alaska. An adult could legally possess up to 4 ounces for personal use. All that changed when Regan took office. After several years of court room bickering the Alaskan state government finally outlawed marijuana in 1984, this was in direct response to the federal government threatening to cut off their federal state highway funds.
However if California does decide to legalize marijuana for recreational use in the hopes of gaining 1.4 billion dollars a year in tax revenue a legal marijuana industry is expected to generate I highly doubt the feds would to anything. Remember California has a hell of a lot of political clout. Without California’s all important electoral votes Obama knows he doesn’t stand a snowballs chance of getting reelected.
Why don’t you just join a gang. Understand you’ll be more likely to get your ass beat or killed by the police, but you also got a better chance of getting away with anything you might do.
